Second Degree DWI

- Blood Alcohol Content (BAC) of .20 or higher
- Two aggregating factors including, but not limited to: refusal of chemical testing, BAC of .20 or higher, and having a child under the age of 16 in the car.
The maximum sentence for 2nd degree DUI is 1 year of jail time and $3,000 in fines. Additional punishments include revocation of the vehicle involved in the incident, loss of drivers license, and impounded (or whiskey) plates.
